GDPR-Compliant AI Tools for European Brokers

Not all AI tools are built for Europe. Learn what to look for — data residency, DPA agreements, retention policies — and how Rubo addresses each requirement.

Why GDPR matters more for brokers than most businesses

Insurance and real estate brokers handle some of the most sensitive personal data in any industry: health disclosures, financial statements, property valuations, identity documents, and family circumstances. When you add an AI tool to your workflow, every piece of data that touches that tool becomes subject to GDPR scrutiny.

The stakes are higher than most brokers realise. A single AI tool that processes client data without a proper Data Processing Agreement (DPA) can expose your brokerage to enforcement action — regardless of whether any data was actually misused.

The three questions every broker should ask

Before deploying any AI tool that handles client data, get clear answers to these three questions:

1. Where is the data processed and stored?

GDPR requires that personal data transferred outside the EEA either goes to a country with an adequacy decision or is covered by appropriate safeguards (Standard Contractual Clauses). Many US-based AI providers process data in American data centres by default. That creates GDPR exposure unless SCCs are in place.

2. Is there a signed Data Processing Agreement?

Article 28 of GDPR mandates a DPA between any data controller (you) and any data processor (the AI vendor). Without one, you're in breach regardless of what the vendor's privacy policy says. Any reputable AI vendor serving European customers will have a DPA ready to sign — if they don't, that's a red flag.

3. What is the data retention policy?

Your AI tool should not retain client conversation data indefinitely. Ask the vendor: how long is data stored? Can you request deletion? Is data used to train future models? Each of these questions has compliance implications.

Common failure modes

Using consumer AI tools for client work

General-purpose AI assistants like ChatGPT (the free/pro version) are consumer products. They may use your inputs to train future models and are not designed for professional data processing. Using them to draft client communications or analyse policy documents almost certainly violates your GDPR obligations.

Assuming SaaS equals compliance

"We're ISO 27001 certified" or "we use enterprise-grade security" are not GDPR compliance statements. Security certifications address data protection from breaches; GDPR compliance addresses your lawful basis for processing, data subject rights, and processor obligations. These are different things.

Missing the DPA for smaller vendors

It's easy to get a DPA from Salesforce or Microsoft. It's harder to remember to ask for one from the smaller AI tool your team adopted informally. Build a process: every tool that touches client data gets a DPA, full stop.

What GDPR-compliant AI looks like in practice

A properly configured AI tool for broker workflows should:

  • Process all data within the EEA (EU data residency by default, not as an add-on)
  • Provide a signed DPA before you process any client data
  • Not use your client data to train AI models without explicit consent
  • Support data subject access and deletion requests
  • Log all AI-assisted interactions so you can produce an audit trail if needed
  • Retain conversation data only as long as necessary (configurable retention windows)

Before deploying any AI tool in your brokerage:

  • [ ] Confirm EU data residency (or SCCs if non-EU)
  • [ ] Sign a DPA with the vendor
  • [ ] Review data retention and deletion policies
  • [ ] Confirm client data is not used for model training
  • [ ] Update your own privacy notice to reflect the new processing
  • [ ] Train your team on what can and cannot be shared with the AI
